OCEANSIDE — San Diego Superior Court Judge Daniel Goldstein dismissed felony DUI charges against a woman Feb. 26 after two mistrials were declared in her case.
During two trials, a jury deadlocked on whether Tammy Evans, a repeat DUI offender, drove drunk to the Oceanside Harbor last June. Police contacted Evans on the beach with alcohol approximately 15 to 30 minutes after she arrived. Two teens, who allegedly Evans had asked to party with her, reported the 43-year-old woman to authorities. She had a .21 BAC two hours after her arrest.
Evans was convicted in January 2007 of three separate DUIs. In two of the offenses, she had a .32 and .34 BAC, respectively. In California, a felony DUI is charged after an individual’s third misdemeanor DUI conviction. She had only been out of jail a month from the aforementioned offenses when she was arrested in June.
Prior to her first trial in September, Evans pleaded guilty to driving on a suspended license, a misdemeanor. Held on $530,000 bail, she spent more than seven months in jail during the most recent case.
